Planning Application

The Planning Application (1/08/20502/F) was submitted in March, 2008.  It was scheduled for consideration by South Shropshire District Council Development Control Committee on 30th April, but this was deferred to a special meeting arranged for 20th May, 2008.

The Planning Officer's Report, which recommended approval, can be viewed here.  However, this meeting was postponed by the head of Planning and Building Control, which resulted in BCBP Ltd lodging an appeal against non-determination on 22nd September, 2008.  The appeal will take the form of a Public Inquiry, to be held at Bishop's Castle Community College on 3rd to 5th March, 2009.

Shropshire County Council have reviewed the case file on behalf of SSDC and have confirmed that the approach and process followed by SSDC officers in assessing the application were appropriate and that the conclusions could be supported.  SSDC's legal advice is that the revised form of Condition 31 (viewable on page 6 of this document from SSDC) is an acceptable and enforceable way to progress the application.

SSDC resolved on 10th December, 2008 to attend the Public Inquiry only to request the imposition of the conditions.
